DISCLAIMER / Terms and conditions
By accessing and using the Web Site Mylaps.com operated by Track Timing BV (Track Timing) you agree to the following terms and conditions, as well as to the terms and conditions of the AMB Privacy Policy:
1. Although care has been taken to ensure the accuracy of the information on the Mylaps.com homepage and the other Mylaps.com related web sites (together referred to as "Web Sites"), INFORMATION ON THOSE SITES IS PROVIDED "AS IS" WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE Track Timing does not warrant that the Web Sites or the servers, which make these Web Sites available, are free from viruses or any other harmful elements.
2. Track Timing reserves the right to make changes and/or updates with respect to the information contained on the Web Sites, including this Disclaimer, at any time without (prior) notice.
3. The Web Sites may provide links to other web sites that are not under the control of Track Timing. Track Timing shall not be responsible in any way for the content of such other web sites. Track Timing provides such links only as a convenience, and the inclusion of any link to any such web sites does not imply endorsement by, nor responsibility of, Track Timing of/for the content of such sites.
4. All information and race data uploaded to the MyLaps.com website will become (intellectual) property of Track Timing. Users hereby unconditionally transfer any right of intellectual property which they may have regarding to any (uploaded) race data to Track Timing. Should any formal requirement be necessary for transfer, users will, unconditionally, provide their cooperation to meet these requirements. Track Timing, at its sole and absolute discretion, may sell or provide part or all of this data and information to third parties or use this data for commercial activities, including, but not limited to, selling banners to advertisers.
5. All material and expressions of users of the Web Sites are the sole responsibility of these users. Users warrant that they have obtained all necessary licenses, consents and permissions to use and to authorize Track Timing to use (which authorization is hereby given), any and all material and/or information subjected to rights of intellectual property (and or any other right which might prohibit the use on the Web Sites) in the manner contemplated by the Web Sites and these terms and conditions. Any user will hold indemnified Track Timing for any and all claims (including the (legal)costs that have to be made regarding that claim) arising from or in relation to the material and/or information supplied (uploaded or posted) by the user, including but not limited to copyright infringements and/or violations of law or regulations.
6. Expressions (postings of any kind) of users are the opinion of these individual users and do not in any way reflect the opinion of Track Timing. Track Timing reserves the right to remove information or messages, containing, unlawful, infringing, slanderous, obscene or discriminating material or any other unacceptable expressions, including (motion) pictures.
7. Track Timing, its employees, directors, affiliates, subsidiaries and/or related companies will in no way whatsoever be liable for any direct, indirect, punitive, or incidental damages that result from the use or inability to use the Web Sites or their contents or for damages of any kind due to use or inability to use of a product or service made available through the Web Sites. Track Timing does not represent that the use of the information contained in the Web Sites does not infringe upon the rights of any third party.
8. Track Timing reserves the right to block access to the Web Sites or deny the usage of services offered on the Web Sites for certain (groups of) users due to misconduct or infringements of rights, or any other action, such to the sole discretion of Track Timing.
9. It is Track Timing's goal to provide fast and accurate data on the Mylaps.com website, 24 hours a day, 7 days a week. However, Track Timing cannot be held responsible if data on the website is incorrect, if the website is providing data at a slow speed or if the website is down. Track Timing DOES NOT guarantee a certain uptime for the MyLaps.com website.
10. Some services on Mylaps.com may be free, for other services there may be a charge. Track Timing reserves the right to change the price of any of its services on Mylaps.com, be it for organizations that upload the results and information or visitors that view that information. Services that are for free now, may be charged for in the future. Track Timing may make these changes at any time, without prior notice.
11. Regarding financial and corporate data, such as annual reports, contained on the Web Sites, only the original English language version can be considered the authentic version.
12. All intellectual property rights, including but not limited to copyrights, patents, database rights and trademarks on the Web Sites and their content are the property of Track Timing or its licensors. It is not permitted to multiply (part of) the Web Sites, other than in unmodified form for (non commercial) informational personal use, by downloading it and viewing it on a single computer, or printing a single hardcopy and provided the copyright symbol and notice(s) as set out at the bottom of the page concerned are maintained. Making the website available to third parties, without the prior written consent of Track Timing is prohibited.
13. These terms and conditions shall be governed by and construed in accordance with the laws of The Netherlands. The law of the Netherlands will be applicable in the event of a dispute. Any dispute will be brought before the competent court in Haarlem.
14. Track Timing is a trade name of AMB Identification & Timing B.V. any warranties, disclaimers and or rights made in this document on behalf of Track Timing are also made on behalf of AMB Identification & Timing BV, as well as on behalf of AMB i.t. US Inc and/ or any other related company.
